進一步做好建筑企業跨省承攬業務監督管理工作

   為推動建(jian)(jian)立(li)統一開(kai)放、公平競爭的建(jian)(jian)筑(zhu)市場秩序,促進(jin)建(jian)(jian)筑(zhu)企(qi)業(ye)(ye)(ye)持續健康發展,日前住房和城鄉建(jian)(jian)設(she)部下(xia)發通知,要求進(jin)一步做(zuo)好建(jian)(jian)筑(zhu)企(qi)業(ye)(ye)(ye)(包括(kuo)工(gong)程勘察(cha)、 設(she)計、施(shi)工(gong)、監理(li)、招標代(dai)理(li),下(xia)同(tong))跨省承攬業(ye)(ye)(ye)務監督管(guan)理(li)工(gong)作(zuo)。通知明(ming)確提出,外地建(jian)(jian)筑(zhu)企(qi)業(ye)(ye)(ye)與本地建(jian)(jian)筑(zhu)企(qi)業(ye)(ye)(ye)同(tong)等待遇,嚴禁設(she)置地方壁壘。

  通知指出(chu),各級(ji)住房城鄉(xiang)建(jian)設(she)行(xing)(xing)政主管部門(men)(men)應當嚴格執行(xing)(xing)國家(jia)相(xiang)關(guan)(guan)法律、法規,給予(yu)外地(di)(di)(di)(di)建(jian)筑企(qi)(qi)業(ye)(ye)與本地(di)(di)(di)(di)建(jian)筑企(qi)(qi)業(ye)(ye)同等待遇,嚴禁設(she)置地(di)(di)(di)(di)方壁壘(lei)。不(bu)(bu)得(de)對 外地(di)(di)(di)(di)企(qi)(qi)業(ye)(ye)設(she)立(li)審批性(xing)備(bei)案和借用(yong)備(bei)案名義收取費用(yong),不(bu)(bu)得(de)強制(zhi)要求(qiu)外地(di)(di)(di)(di)企(qi)(qi)業(ye)(ye)在本地(di)(di)(di)(di)注冊(ce)獨立(li)子(zi)公(gong)司、分(fen)公(gong)司,不(bu)(bu)得(de)強行(xing)(xing)扣押外地(di)(di)(di)(di)備(bei)案企(qi)(qi)業(ye)(ye)和人員的相(xiang)關(guan)(guan)證照資料,不(bu)(bu) 得(de)要求(qiu)企(qi)(qi)業(ye)(ye)注冊(ce)所在地(di)(di)(di)(di)住房城鄉(xiang)建(jian)設(she)主管部門(men)(men)或其上級(ji)主管部門(men)(men)出(chu)具相(xiang)關(guan)(guan)證明等。

  通知明確(que),實行(xing)備(bei)案的(de)各省(區、市)住房城鄉建設主(zhu)管部門(men)應當隨時(shi)接(jie)收外地企業(ye)(ye)備(bei)案材料,即(ji)時(shi)辦(ban)理備(bei)案手續,僅限于對企業(ye)(ye)營業(ye)(ye)執照、企業(ye)(ye)資質證(zheng)(zheng) 書、企業(ye)(ye)安(an)全生產許可(ke)證(zheng)(zheng)、企業(ye)(ye)駐本(ben)地辦(ban)公場地租賃(lin)(或產權)證(zheng)(zheng)明、企業(ye)(ye)法定代表人簽署的(de)企業(ye)(ye)駐本(ben)地的(de)業(ye)(ye)務負責人授權委托書進行(xing)備(bei)案復核。

  通(tong)知要(yao)(yao)求(qiu),省(區、市(shi))住房(fang)(fang)城(cheng)鄉建設主(zhu)管部(bu)門應(ying)當將已備(bei)案(an)(an)的外地企(qi)業(ye)信(xin)息及時通(tong)報本地區各級(ji)住房(fang)(fang)城(cheng)鄉建設主(zhu)管部(bu)門,備(bei)案(an)(an)信(xin)息應(ying)當及時向社會公(gong) 開。省內(nei)各級(ji)建設主(zhu)管部(bu)門不得要(yao)(yao)求(qiu)已在本省辦理過登記(ji)備(bei)案(an)(an)手(shou)續的企(qi)業(ye)重復備(bei)案(an)(an)。省(區、市(shi))住房(fang)(fang)城(cheng)鄉建設主(zhu)管部(bu)門應(ying)當結合建筑市(shi)場監管的實際情況(kuang),調整監 管思(si)路,創新監管機制,在簡化備(bei)案(an)(an)手(shou)續的同時,加大對備(bei)案(an)(an)企(qi)業(ye)市(shi)場行為的動態監管力度。對允(yun)許(xu)其(qi)他單(dan)位或(huo)個(ge)人(ren)以本單(dan)位名(ming)義承攬(lan)業(ye)務(wu)(wu),以任何(he)方式同不具備(bei)資(zi) 質、資(zi)格(ge)條(tiao)件的單(dan)位或(huo)個(ge)人(ren)合作承攬(lan)業(ye)務(wu)(wu),拖欠工(gong)(gong)程款(kuan)和(he)農民工(gong)(gong)工(gong)(gong)資(zi),圍標串(chuan)標、轉(zhuan)包和(he)違法(fa)(fa)分(fen)包,超越資(zi)質等級(ji)承攬(lan)業(ye)務(wu)(wu)等違法(fa)(fa)違規行為和(he)發生質量安全(quan)事故的企(qi) 業(ye)依法(fa)(fa)予(yu)以查處。

  通知還要求,省(區、市)住房城鄉建設主(zhu)管(guan)部門(men)應當加強(qiang)對本地(di)(di)區各級主(zhu)管(guan)部門(men)跨省備(bei)案管(guan)理工作的指導和監督(du),對在市場準入、招標投標等(deng)方面設立 不合理條(tiao)件排斥或限制外地(di)(di)企(qi)業(ye)(ye)承攬業(ye)(ye)務的,上級主(zhu)管(guan)部門(men)應當予以制止(zhi),并責令其(qi)限期(qi)改正,逾期(qi)仍(reng)未改正的,上級主(zhu)管(guan)部門(men)應當予以通報批評。

  通知(zhi)最(zui)后強調,省(sheng)(sheng)(sheng)(區(qu)、市)住(zhu)(zhu)房(fang)(fang)城(cheng)鄉建(jian)(jian)(jian)設主(zhu)管(guan)部(bu)(bu)門(men)(men)應對所(suo)(suo)有(you)本地(di)(di)和外地(di)(di)的建(jian)(jian)(jian)筑(zhu)企(qi)業(ye)建(jian)(jian)(jian)立信用檔案,積極推動本地(di)(di)區(qu)建(jian)(jian)(jian)筑(zhu)市場監管(guan)信息系統建(jian)(jian)(jian)設,通過市 場和現場的兩場監管(guan)聯動,實施跟蹤管(guan)理。工程項目(mu)所(suo)(suo)在地(di)(di)縣級及以上地(di)(di)方建(jian)(jian)(jian)設主(zhu)管(guan)部(bu)(bu)門(men)(men)應當依法查(cha)處(chu)本區(qu)域跨(kua)省(sheng)(sheng)(sheng)企(qi)業(ye)和個人在承(cheng)攬業(ye)務(wu)中的違(wei)法違(wei)規行為(wei)(wei),并(bing)將(jiang)違(wei) 法事(shi)實、處(chu)理結果(guo)或(huo)處(chu)理建(jian)(jian)(jian)議通過省(sheng)(sheng)(sheng)(區(qu)、市)住(zhu)(zhu)房(fang)(fang)城(cheng)鄉建(jian)(jian)(jian)設主(zhu)管(guan)部(bu)(bu)門(men)(men)及時(shi)告知(zhi)該企(qi)業(ye)注冊地(di)(di)省(sheng)(sheng)(sheng)(區(qu)、市)住(zhu)(zhu)房(fang)(fang)城(cheng)鄉建(jian)(jian)(jian)設主(zhu)管(guan)部(bu)(bu)門(men)(men)。對于重大違(wei)法違(wei)規行為(wei)(wei),按(an)照有(you) 關規定由省(sheng)(sheng)(sheng)(區(qu)、市)住(zhu)(zhu)房(fang)(fang)城(cheng)鄉建(jian)(jian)(jian)設主(zhu)管(guan)部(bu)(bu)門(men)(men)報(bao)送住(zhu)(zhu)房(fang)(fang)城(cheng)鄉建(jian)(jian)(jian)設部(bu)(bu),作為(wei)(wei)不(bu)良行為(wei)(wei)信息向社會公布,并(bing)按(an)有(you)關規定嚴肅查(cha)處(chu)。
